Late January, the High Court sitting in Meru ruled that former Laisamis MP Joseph Lekuton will pay a former Marsabit MCA Sh600,000 for defaming her.
Justice Alfred Mabeya ruled that he former nominated MCA Zamzam Hussein Aligela had sufficiently proved that Mr Lekuton had insulted her during a political rally presided over by the then Marsabit Governor now National Treasury CS Ukur Yatani.
During the meeting that happened five years ago, it was heard that Mr Lekuton approached Ms Zamzam from a crowd of about 50 women as she served refreshments and enquired in the Samburu language: What is this prostitute doing here?
The former legislator continued, ‘You are a prostitute, I will finish you”.
Ms Zamzam stated that she was taken aback by the MPs public utterances as they had a good working relationship and she wept uncontrollably.
That time, the function to open the local Laisamis sub-county office was momentarily thrown into disarray before clam was restored.
The second term nominated ward representative had sought Sh8 million which Justice Mabeya had declined stating that the Ms Zamzam did not substantiate her claim.
“I hold that the defendant did utter the words complained of. That said the words were defamatory and they referred to the plaintiff. Accordingly, the plaintiff did on a balance of scale prove her case against the defendant. I will not award any exemplary damages as they were not proved. As regards to the apology sought due to the passage of time I don’t think the same will suffice at this point”, Justice Mabeya said
