A man, Andrew Mackenzie has been charged before the Kibera Chief Magistrates court with the offence of defiling a minor contrary to Section 8(1) of the Sexual Offences Act.
As per the prosecution, the accused is said to have left his wife inside the house and rushed out when he saw the victim going to an outdoor bathroom. The accused then stormed into the bathroom while she was taking a bath.
According to the victim, before the accused committed the atrocious act, she covered her mouth with her own towel and issued her with death threats if anyone was to know of the incident.
After the incident that occurred on 26 September, 2019 at Kangemi Estate in Nairobi, the girl finished taking her bath and proceeded to school without saying a word to anyone.
From the written statements recorded at Kabete police station, the victim was uneasy and disturbed at school. She could not bear anymore and reported the matter to the school secretary. It is then that the school administration took up the matter. Through a phone call, they informed the victim’s mother who rushed to school. The victim was then taken to a hospital and afterwards to the police station.
The accused denied the defilement charges and Senior Principal Magistrate Barbara Ojoo granted him Ksh. 300,000 bond and a surety of the same amount.
The matter will be mentioned on October 8, 2019 whereas the hearing is scheduled for November 11, 2019.
As per Section 8(3) of the Sexual Offences Act, If found guilty, the accused could face a conviction of up to 20 years imprisonment
