Issah Kemoi, a 28 year old man has been jailed for 17 years. The man who had been accused of sodomizing and grievously harming his biological three year old son at Riwo Ward in West Pokot County was found guilty by a court of law.
Issah Kemoi was sentenced on two counts.
In the first count, he was found guilty of contravening Section 162 (a) of the Penal code by having carnal knowledge of his three-year-old son against the order of nature. In the second count he was found guilty of causing grievous body harm to a minor contrary to Section 234 of the Penal code.
In his judgement, the Kapenguria Law Courts Principal Magistrate Hon Samuel Mutai found the man guilty and sentenced him to 7 years and 10 years for the first and second counts respectively.
“Considering that it is his first offence, I, therefore, sentence you to 17 years in prison for both counts”, the magistrate said.
The magistrate added that all the five witnesses who testified against the accused in court gave corroborating statements adding that he saw no reason why a three-year-old son would lie against his own father.
On the Second count of causing grievous harm, a witness testified in court that the man burnt his son on the thighs with a cigarette, cut his penis, broke his clavicle and fractured his shoulder.
The child was admitted at Kacheliba Sub County Hospital for two weeks where he underwent treatment. Medical reports from the hospital confirmed that the boy was in pain and had been sodomized as he could not be able to urinate.
The prosecution affirmed that the case had been proved beyond reasonable doubt and thus the man should be imprisoned.
