Police Officer denies Conspiracy to kill charges

Francis Barasa Simiyu, a county communication officer (Signal) stationed at the Machakos police headquarters, was charged at a Kitale law court on Thursday. The police officer allegedly conspired with a 42 year old woman to kill her husband contrary to Section 393 of the Penal code. 

The officer had been apprehended by detectives from Kitale at his home in Bungoma County on Tuesday 29 October, 2019.

On Wednesday, the accused was taken to court for plea taking . However, Resident Magistrate Mary Osoro said that her court lacked the jurisdiction to hear the conspiracy charges. 

Seen court documents revealed that Mr. Simiyu conspired to commit a felony at an unknown place between August 21 and September 3, 2017.

The officer had been hired by Jackline Walekhwa Wanjala to kill  her husband John Wamalwa Nyongesa.

On Thursday October 31, 2019 appearing before Senior Principal Magistrate Mary Immaculate Moranga, the officer refuted the charges.

The prosecution opposed the bond terms on grounds that the suspect had been at large since the offence was committed.

“It has taken manpower and resources to have him arrested. He is a flight risk and if given bond he is likely to abscond,”said the state counsel, Ms Marion Konga.

The accused was denied bond and a court order was issued for him to be remanded at the Kitale GK prison.

The case will be mentioned on November 5, 2019.
