On Thursday, October 17, 2019 at Kibera Law Courts, a four year old girl testified against a suspect accused of defiling her with a sex toy on various dates between September 1, 2018 and March 31, 2019 in Dagoretti.

The accused is also facing an alternative charge of sexually assaulting a person through unlawfully penetrating the genital organs of another with an object not carried out for purposes outlined in Section 5(1)(a)(ii) the Sexual Offences Act.

Section 5(1)(a)(ii) of the Sexual Offences Act states that any person who unlawfully penetrates the genital organs of another person with an object manipulated by another or that person except where such penetration is carried out for proper and professional hygienic or medical purposes is guilty of an offense termed sexual assault which upon conviction attracts a penalty of imprisonment for a term of not less than ten years or life imprisonment as per the relevant circumstances prevailing

The victim recalled that Yvonne Minamo, a middle aged woman, whom she referred to as ‘aunt’ stripped her naked before proceeding to insert a vibrating machine inside her vagina.

According to the victim she frequently visited the accused house where she would play hide and seek with the daughter of the accused. “Yes, I know her house, We played together. I remember she used to remove my shoes, panties and clothes and insert the object here,”she said pointing at her private parts.

The prosecution informed the court that the victim’s mother realized that her daughter had been defiled upon making out an infection as a reason to why the victim was constantly touching her private part. It is then that the child informed her that Mimamo, who was a neighbor, had been inserting an object in her private part.

The prosecution also stated that a doctor from Nairobi Women’s Hospital had confirmed that she had been defiled.

The mother further testified that the accused would sneak into her house and disappear with the child.

Senior resident magistrate Boaz Ombewa released her on Ksh. 400,000 bond pending further scheduled hearing date.
